1 This is an original proceeding instituted by Harold Buster Penny, an inmate of the State Penitentiary, seeking his release from confinement in the State Penitentiary where he is presently incarcerated by virtue of a judgment and sentence rendered against him by the District Court of Oklahoma County on the 18th day of April, 1961, Case No. 26,782, and praying in the alternative that the sentence of twenty years imprisonment be reduced to a sentence of ten years imprisonment.
